Rental Terms & Conditions

1. Rental Eligibility & Driver Age

• Minimum driver age is 21 years old.
• Maximum driver age is 70 years old.
• The driver must have held a valid full driving licence for at least one year.
• Malaysian probationary “P” licences are strictly not accepted.
• Only registered and approved drivers (including paid additional drivers) may drive the vehicle.

2. Required Documents

• Local Customers: Original Malaysian Identity Card (MyKad) and a valid Malaysian driving licence.
• Foreign Customers: Original Passport and a valid driving licence from their home country.
• An International Driving Permit (IDP) may be required if the original licence is not in English or is not legally accepted in Malaysia.
• All bookings remain subject to our insurance requirements and final document verification during vehicle collection.

3. Booking and Payment Terms

• A 20% booking deposit is required at the time of online booking to secure the reservation.
• The booking is only confirmed once the online booking deposit has been successfully received.
• The remaining 80% balance must be paid before or during vehicle collection via bank transfer, cash, card, or another payment method approved by CUN CUN Travel.
• A minimum rental period of 1 day (24 hours) applies.

4. Security Deposit

• A refundable security deposit of RM400 per vehicle must be paid by cash or bank transfer during vehicle collection.
• The security deposit will be refunded within 3 to 7 working days after the vehicle is returned and inspected.
• Deductions may be made from the security deposit for: damage, missing fuel, traffic summonses, parking charges, toll charges, late returns, cleaning charges, or missing accessories/keys.

5. Insurance Excess and Super CDW

• The standard insurance excess for our vehicles is RM3,000.
• Customers may purchase Super Collision Damage Waiver (CDW) at RM45 per rental day to reduce the excess to RM1,000.
• Important: CDW does not cover negligence, illegal driving, tyre or rim damage, lost keys, incorrect fuel, interior damage, flooding, or driving by an unauthorised person. The customer remains fully liable for damages arising from these events.

6. Cancellation and Refund Policy

• More than 72 hours before pick-up: Full refund of the booking payment, less any non-refundable payment-processing fees.
• Between 24 and 72 hours before pick-up: 50% refund of the booking payment.
• Less than 24 hours before pick-up: No refund.
• No-show or Failure to provide required documents: No refund.
• Rejected booking by CUN CUN Travel (prior to collection): Full refund.
• Date changes are subject to vehicle availability and must be requested at least 48 hours before the scheduled pick-up time.

7. Permitted and Prohibited Vehicle Use

• The vehicle must only be driven on officially gazetted and paved roads. Off-road driving, racing, or driving on beaches is strictly prohibited.
• The vehicle must not be used for illegal activities, subleasing, or commercial e-hailing services.
• Pets are not allowed inside the vehicle unless explicitly approved by management.

8. Fuel Policy

• The vehicle must be returned with the same fuel level as when it was collected.
• Missing fuel will be charged according to the current market rate plus a refuelling service charge.
• No refunds will be provided for excess fuel left in the tank.

9. Late Return

• One rental day is strictly calculated as a maximum of 24 hours.
• Late returns will incur additional charges. Returns exceeding 5 hours late will typically be charged as a full additional rental day.
• Customers must inform us in advance if they anticipate a late return.

10. Accidents, Breakdowns, and Vehicle Replacement

• In the event of an accident or breakdown, the customer must immediately notify CUN CUN Travel and the local authorities (if applicable).
• Do not abandon the vehicle or arrange unauthorized towing.
• Vehicle replacement is subject to availability. CUN CUN Travel is not obligated to provide a replacement if the breakdown or accident was caused by customer negligence or breach of these terms.

11. Summonses, Tolls, Parking, and Cleaning

• The customer is fully responsible for all traffic summonses, toll charges, and parking fees incurred during the rental period.
• Vehicles returned with excessively dirty interiors (e.g., mud, food spills, heavy stains) will incur a cleaning charge.
• Smoking is strictly prohibited inside the vehicle. A heavy penalty and cleaning fee will apply if evidence of smoking is found.

12. Booking Rejection

A booking may be rejected by Cun Cun Travel for reasons including:

• The selected vehicle is unexpectedly unavailable due to accident, breakdown, maintenance or late return by the previous customer.
• The customer does not meet the minimum rental or driving licence requirements.
• The customer provides incomplete, incorrect or unverifiable documents or information.
• The customer’s driving licence is invalid or not accepted for driving in Malaysia.
• There is suspected fraud, misuse of the vehicle or a security concern.
• Payment or security deposit requirements are not completed.
• The booking contains an obvious pricing or system error.
• Circumstances beyond our reasonable control prevent us from providing the booked vehicle.

If Cun Cun Travel rejects and cancels a confirmed booking and no suitable replacement vehicle is accepted by the customer, the customer will receive a full refund of the amount paid to Cun Cun Travel.

13. Customer Responsibility & Company Liability

The customer assumes all risks and liabilities associated with the use of the vehicle during the rental period. CUN CUN Travel shall not be held liable for any loss of personal belongings left in the vehicle, nor for any indirect or consequential damages, delays, or missed flights arising from vehicle breakdowns or unforeseen circumstances.

14. Personal Data and Privacy Policy

By proceeding with the booking, you agree that your personal data (including identification documents) may be collected, stored, and processed by CUN CUN Travel for the purposes of vehicle rental, insurance verification, and legal compliance. We respect your privacy and will not share your personal information with unauthorized third parties.
